The Procedural Point
The applicant conceded the second preliminary objection and acknowledged that the supporting affidavit did not comply with Rule 24(3)(a) of the Labour Court Rules, G.N. No. 106 of 2007.
The Order
The preliminary objection succeeded and the application was struck out as incompetent. The Court stated that the applicant remained at liberty to file a competent application, if so advised, subject to the law of limitation.
